First Degree Felony

- The victim is a minor between the ages of 13 and 18 years old and the accused perpetrator was in a position of authority

- The use of force resulted in bodily harm to the victim
- The use of force when the accused perpetrator is aided by one or more people
- The incident took place during the commission of any other felony
- The accused perpetrator was armed with a deadly weapon
Third Degree Felony
When it is alleged that an individual committed criminal sexual penetration through the use of force or coercion, it is considered a third degree felony.
Fourth Degree Felony
An individual may be charged with a fourth degree felony for being accused of criminal sexual penetration that is not defined in the above sections.
