Penalties for Multiple DWI Convictions in New Mexico

- A mandatory minimum 24 hours of community service
- Participation in a screening program
- Ignition interlock device on vehicles for 1 year
Second DWI Conviction (misdemeanor)
- Up to 364 days in jail
- A fine of up to $1,000
- A mandatory minimum 48 hours of community service
- Participation in a screening program
- Participation in a driver treatment program for alcohol or drugs
- Ignition interlock device on vehicles for 2 years
Third DWI Conviction (misdemeanor)
- Up to 364 days in jail
- A fine of up to $1,000
- At least 96 hours of community service
- Participation in a screening program
- Participation in a driver treatment program for alcohol or drugs
- Ignition interlock device on vehicles for 3 years
Fourth DWI Conviction (felony)
- Up to 18 months in prison
- A fine of up to $5,000
- Participation in a screening program
- Participation in substance abuse counseling
- Participation in a driver treatment program for alcohol or drugs
- Ignition interlock device on vehicles for the remainder of the offender’s life
Fifth DWI Conviction (felony)
- Up to 2 years in prison
- A fine of up to $5,000
- Participation in a screening program
- Participation in substance abuse counseling
- Participation in a driver treatment program for alcohol or drugs
- Ignition interlock device on vehicles for the remainder of the offender’s life
Sixth DWI Conviction (felony)
- Up to 30 months in prison
- A fine of up to $5,000
- Participation in a screening program
- Participation in substance abuse counseling
- Participation in a driver treatment program for alcohol or drugs
- Ignition interlock device on vehicles for the remainder of the offender’s life
Seventh or Subsequent DWI Conviction (felony)
- Up to 3 years in prison
- A fine of up to $5,000
